PERSONAL DATA PROCESSING

Personal data will be processed for the purposes of completing the reservation process, clarifying any circumstances of a potential breach of the Terms and Conditions or applicable laws, and handling possible complaints.

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), we inform that:

The Data Controller of personal data obtained in the reservation process, within the meaning of applicable law, is Management Partner Jarosław Pawliński, ul. Potocka 8/33, 01-652 Warsaw, Poland.

The Data Processor of personal data is the online reservation system Hotres.pl, owned by LEMONPIXEL.pl Roman Korczyński, based in Jelenia Góra (58-570), ul. Młyńska 12A, hereinafter referred to as Hotres.pl.

Personal Data

For the purposes of the reservation process and issuing a sales document, the Guest’s personal data is collected. Providing personal data is voluntary but necessary to complete the reservation process.

The Guest has the right to access, rectify, or delete their personal data, as well as to restrict its processing.

An optional consent to process personal data for marketing purposes requires checking the appropriate “checkbox” during the reservation process. This consent may be withdrawn at any time by sending a message to: jaroslaw.pawlinski@gmail.com.

Detailed purposes and scope of data processing within the Hotres system are defined in the attached documentation.

Obligations of the Data Controller

The Controller ensures that Guests’ personal data is not shared with third parties and will take all necessary measures, using their knowledge and experience, to fulfill this commitment.

The Controller reserves the right to share personal data with authorized entities (Subprocessors) and in cases required by applicable law — in particular, with entities such as online payment systems or reception management software.

The Controller is obliged to maintain confidentiality of all information obtained for the purpose of completing the reservation process. This obligation remains in force for an indefinite period.

Obligations of Hotres.pl

As the Data Processor, Hotres.pl ensures the implementation of appropriate technical and organizational measures, as well as additional IT safeguards, based on verified servers and systems used for processing personal data in electronic services.

Hotres.pl declares that the IT systems used for processing personal data meet the requirements of applicable law and are protected at a high level, in accordance with the Regulation of the Minister of Internal Affairs and Administration of 29 April 2004 on documentation of personal data processing and technical and organizational conditions for IT systems used for personal data processing.

Subcontractors and employees of Hotres.pl are properly authorized to process personal data in connection with the reservation process, which is accepted by both the Controller and the Guest.

To ensure the highest level of data security in compliance with GDPR requirements, Hotres.pl undertakes to:

  1. Encrypt and anonymize personal data transmissions.

  2. Continuously ensure confidentiality, integrity, availability, and resilience of data processing systems and services.

  3. Maintain the ability to quickly restore access to personal data in case of a physical or technical incident.

  4. Regularly test, assess, and evaluate the effectiveness of technical and organizational measures ensuring data processing security.

Final Provisions

The Data Controller reserves the right to modify the provisions of these Terms and Conditions at any time and at their sole discretion. In particular, changes may be made in the event of:

  • The need to adapt the Terms and Conditions to mandatory legal provisions or amendments to applicable law affecting its content;

  • The need to comply with recommendations, interpretations, rulings, decisions, or judgments of public authorities or courts;

  • The expansion or modification of the functionality of Hotres.pl.
